Durham County Council is seeking a supplier for monthly Regulation 44 visits by an Independent Person to carry out rigorous and impartial assessments of safeguarding and welfare arrangements at its Community Children's Homes and Aycliffe Secure Centre. The contract covers 15 Community Children's Homes (including a Short Breaks Service and a Step‑Down from Secure home) and a further five homes within Aycliffe Secure Centre, with an expectation that up to five additional Community Children's Homes may be developed and added to the contract as they are registered with Ofsted, with scope and contract value adjusted accordingly. The visits must meet the requirements of the Children's Homes Regulations 2015 (Regulation 44). The Council's view is that TUPE will apply to this contract, and bidders are advised to seek their own legal advice on TUPE and the effect of the TUPE clause in the contract terms and conditions.
